Wilson, the petition is filed through Mr D Kumanan, Advocate ( Partner- Lawmen and White) on Record stating that the impugned Acts attack the very foundation of the agricultural fabric of the country that was built to safeguard the interests of the farmers and not leave them at the mercy of the new era of privatisation.Elaborating on the repercussions of the said enactments looming large, the writ petition states that impugned Acts will now create an alternative that’s outside the Agricultural Produce Market Committee (APMC), which could result in two perverse consequences. “One is that the APMC continues to set the reference price which will make no sense because if the private players still look to the APMC for a reference price, then the whole idea of getting rid of the inefficient APMC doesn’t hold. Furthermore, Large-scale trade outside the mandi is bound to happen because new players will prefer to trade outside the mandi where they don’t have to pay charges. APMC traders too might now prefer to operate outside the mandi for the same reason,” the petition reads.Delving upon the alleged unconstitutionality of the acts, the petitioner has averred that the Parliament has acted ultra vires of Article 246 of the Constitution by legislating the Acts the subjects related to agriculture are covered under Entry 14,18, 28, 30, 46, 47, 48 of List II, under the seventh schedule and thus, it is the State that has the legislative competence to draft policies or enact any law, with respect to the agricultural fabric of the country. The Parliament has acted ultra vires of Article 246 by legislating the Farmers’ (Empowerment and Protection) Agreement of Price Assurance and Farm Services Act, 2020, the Farmers’ Produce Trade And Commerce (Promotion and Facilitation) Act, 2020, since the same are not within its legislative competence under Lists I and III of Schedule VII of the Constitution. “…. the basic fabric of federalism unites the Union and different States within an overarching political system in such a way so as to allow each to maintain its own fundamental political integrity. Therefore, the federal structure of our democracy cannot be permitted to be destroyed by the Union Legislature blatantly encroaching into matters purely within the domain of the State Legislatures,” the plea reads.Further, it is contended that essentially the Acts aim to take away the basic rights and safeguards that have been provided to the farmers on the subject of agriculture, like APMC Acts, and places the farmers “at the mercy of big corporate entities”, by taking away the provision of Minimum Support Price and opening up the Mandi’s to be controlled by the private players.Inter alia, it has been stated that the acts are “anti farmer and anti-agriculturists”, bought out with the sole intention to benefit few corporations who are close to the corridors of power.”These Acts would pave way for cartelisation and commercialisation of the agricultural produces and if allowed to stand, are going to ruin India as the corporates can, with one stroke, export our agricultural produce without any regulation, and may even result in famines. Very soon, the country which fought for its independence from the British will have to wage war to free itself from the clutches of crony capitalism”- Excerpt of PleaIn this context, the plea seeks issuance of directions for declaration of the provisions of the Acts unconstitutional, illegal and void.Subscribe to LiveLaw, enjoy Ad free version and other unlimited features, just INR 599 Click here to Subscribe. Remy makes Newcastle switch

first_img The France international, who almost joined the Magpies in January from Marseille before sealing a move to Loftus Road, scored six goals in 14 appearances for the R’s last season. The 26-year-old said: “I’m very happy to be a Newcastle player. It will be a huge honour to play for such a big club. I was very flattered by the club’s interest in me back in January and also very happy that they showed interest in me again this summer.” He said: “Loic is a great player and I’m delighted that Joe has got him on board for us. “He’ll be a great addition to the squad, he gives us strength and pace up front and I’m sure he’ll bring plenty of goals. “It’s a big season for Loic, like it is for all our international players ahead of the World Cup, which will only provide extra incentive for him to play at the very top of his game.” Remy revealed that his international ambitions prompted him to make a switch to Newcastle following QPR’s relegation last season. “The Premier League is the best league in the world and that’s where I want to play,” Remy said. “I am very motivated this year to get into the World Cup squad for my country. I know in order to do that I need to have a big season and a successful campaign with Newcastle United. “I am focused on helping the team achieve success this season and scoring as many goals as I can.” Newcastle’s director of football Joe Kinnear, who had only brought in teenager Olivier Kemen from Metz following his appointment by owner Mike Ashley, was pleased to confirm Remy’s services for the forthcoming campaign. “The need for us to strengthen up front was a priority and I have been working very hard to secure one of our targets in this position,” Kinnear said. “I’m delighted to have secured Loic for the season. Now we have him I’m sure he’ll be a huge success for us; I know he’s hungry for goals and is absolutely committed to helping us achieve success this season.” Magpies boss Alan Pardew hailed Kinnear for landing the player which evaded them earlier in the year. QPR striker Loic Remy has joined Newcastle on a season-long loan, the Barclays Premier League side have confirmed. Press Associationlast_img read more

I look to stretch myself with every role Naomi Watts

first_imgNew Delhi: Hollywood star Naomi Watts is careful how she chooses her roles. She likes to find something for herself in every character she plays. The Oscar-nominated actor says with each of her projects she has looked to stretch herself and grow as an artist. “Every time I take on a role, I’m looking to stretch myself, to grow, and find something in it for me,” Watts said, adding: “If the role doesn’t connect with me, how could it possibly connect with an audience?” Also Read – I have personal ambitions now: PriyankaWatts’ latest avatar sees her essaying the life of journalist Gretchen Carlson in the limited series, The Loudest Voice, which dramatises the rise and fall of Carlson’s former boss, Fox News creator Roger Ailes, essayed by Russell Crowe. “Gretchen’s story is one of empowerment and growth in survival, of self-preservation, of taking care of herself, and of the demand to be valued,” said Watts. The Loudest Voice spotlights Ailes’ history of sexual abuse, and Carlson’s landmark sexual harassment lawsuit against her boss that led to his ouster. Watts, 50, found the story of Carlson “mind-blowingly uplifting”.last_img read more

The US Is Downright Mediocre At The World Baseball Classic

Puerto Rico1380.67 Chinese Taipei39-3.26 American fans like to think of the U.S. as the home of baseball; they even tried to mythologize it into the game’s place of origin at one point. And, yes, the majority of the game’s best players are from America. But in the World Baseball Classic, arguably the highest-profile event in international baseball, the U.S. is merely ordinary: It’s 10-10 over the tournament’s history, despite playing a relatively weak slate of opponents over the years. What gives? The WBC has always held more appeal for international players and fans, whose national teams take it far more seriously than the U.S. team does. The U.S. seldom sends its best players to the event, for better (it reduces the risk of key injuries in games that are essentially treated as exhibitions) and worse (it deprives the game of its best players playing on a worldwide stage). That means we won’t be seeing the likes of Bryce Harper and Clayton Kershaw in this year’s Classic, much less living legend Mike Trout. As a result, the U.S. has gotten mediocre results on the field, far from what might be expected out of a country that still considers itself baseball’s standard-bearer. To get a schedule-adjusted ranking of how countries have performed at the four World Baseball Classics,1Including 2017’s games, as of March 8. I calculated Sports-Reference’s Simple Rating System (SRS) for every WBC game since the event began in 2006.2A few more details: I gave more weight to games that took place in later rounds (first-round games had a weight of 1, second-round games a weight of 2, WBC semifinals a weight of 4 and WBC finals a weight of 8.) I also used a home-field advantage term of +0.16 runs per game, matching what it is in MLB since 2006. Among the 13 teams that have played double-digit WBC games, the U.S. ranks just seventh — far behind No. 1 Japan, who has dominated the tournament more than any other country. Mexico69-2.05 Japan — not the U.S. — dominates the World Baseball Classic Japan1973.40 Venezuela107-0.22 Italy47-1.49 United States1010-0.41 COUNTRYWINSLOSSESWEIGHTED SRS Cuba1480.67 Australia19-3.73 Dominican Republic1441.49 Netherlands910-1.20 Teams are ranked according to the Simple Rating System (SRS) for all WBC games since 2006, with extra weight applied to games in later rounds.Source: Wikipedia South Korea1471.79 China28-6.12 National pastime or not, America’s unexceptionalism probably won’t improve until the U.S. starts treating the WBC less like an exhibition event, and more like the international showcase other countries already think it is. Forrest urges the Scots to go for the jugular

first_imgHat-trick hero James Forrest has urged Scotland to go and make the most of their European Championship campaign after topping their Nations League group.Scotland will know their opponents when the draw is made in Dublin on Sunday but are guaranteed a play-off semi-final.“Now we know we have the playoffs we can have a real crack at the qualifier,” the 27-year-old told the Herald.“The manager and the staff will tell us to put this stage of it to bed and now get ready for the games ahead. A lot of people have been indifferent about the Nations League but it has been competitive games and a great chance to qualify.“From the outset, we aimed to top the group and we have done that, so the momentum will be there heading into the qualifiers.“What we have done over the last ten days will give us plenty of confidence and everyone is looking forward to the draw now. We will find out who we’ll be playing but with the way we have performed, so attacking, creating chances and scoring goals we will fancy our chances against anyone.ScotlandScotland needs a hero: Billy Dodds Manuel R. Medina – September 10, 2019 According to former striker, Billy Dodds his country needs a hero to inspire future generations as the team’s hope to qualify to the EURO 2020 is small.“The group has been working hard – we have to keep it going now.”Forrest secured Scotland’s top spot in the Nations League table in historic fashion; the winger became the first Celtic player to score a hat-trick for Scotland for 110 years, with Jimmy Quinn was the last Celt to achieve the same feat.It took his tally to five goals in two games for Scotland and to 11 goals in his last 11 appearances for both Celtic and Scotland. He would be forgiven for feeling this morning that he could spin gold from straw given the fortune he has enjoyed of late.“It was incredible, I’m absolutely buzzing,” he smiled. “It was great scoring my first goals for Scotland the other night so to come to Hampden and get a hat-trick is the stuff of dreams really. It’s up there with everything else I’ve done with Celtic.“I only got my first goals the other day [for Scotland] and now I have five, it’s pretty crazy really. I just want to kick on again from here, get as many caps as I can and hopefully get as many goals as I can.“I just have to keep working hard, play well for Celtic and when we meet up with Scotland again I hope I’m still playing with as much confidence.”last_img read more
